1. Purpose & Definitions

The purpose of this Privacy Policy is to inform you of our policies and procedures regarding the collection, use and disclosure of personal information we receive from users of our Website, Excursionist.com. By visiting the Site, you accept the practices described in this Privacy Policy. This Privacy Policy is effective as of July 1, 2011. This Privacy Policy may be updated from time to time. We will notify you of any material changes by posting the new Privacy Policy on the Website. Your use of the Website following any such notice will signify and constitute your assent to and acceptance of such revised Privacy Policy.

In this Privacy Policy, “we”, “us”, “our” and other similar references mean Excursionist LLC and “you” and “your” and other similar references mean a specific user of the Site. Unless otherwise defined in this Privacy Policy, capitalized terms used below have the same meanings as in our Terms of Service. As used in this Privacy Policy, the terms "using" and "processing" information include using cookies on a computer, subjecting the information to statistical or other analysis and using or handling information in any way, including, but not limited to collecting, storing, evaluating, modifying, deleting, combining, disclosing and transferring information within the United States or internationally.

By providing any personal information to Excursionist, all users, including, without limitation, users in Canada and the member states of the European Union, fully understand and unambiguously consent to this Privacy Policy and to the transfer of such Personal Information across international borders in accordance with Excursionist’s standard operations, including the collection, storage, and processing of such information in the United States of America.

Your information may be transferred to, and maintained on, computers located outside of your state, province, country or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. If you are located outside the United States and choose to provide information to us, we transfer Personal Information to the United States and process it there. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

3. Information Collection and Use

Personal Information. For the purposes of this Privacy Policy, “Personal Information” is any information that identifies you, would enable someone to contact you, that describes your relationship with Excursionist and in some cases, billing information (such as credit card number, cardholder name, and expiration date). Our primary goals in collecting personal information are to provide and improve our Services, to administer any purchase you make on the Website, and to enable Website visitors to enjoy and easily navigate the Website. We collect and store Personal Information when you register to use our Site as a member, ask a question, complete a form, conduct a transaction, or send us an email. While you are not required to submit any information to our Site, if you do not provide the requested information, you may not be able to access or use some of the features and functions of our Site and we may not be able to provide you with certain services. Excursionist uses your Personal Information to complete transactions, respond to your requests, deliver the products and services you request, and notify you of promotions, updates, or special offers that we think may interest you.

Non-Identifying Information. We also collect other information that you provide or give us access to when you visit the Website ("Non-Identifying Information"). Certain Non-Identifying Information would be considered a part of your Personal Information if it were combined with other identifiers in a way that enables you to be identified. But the same pieces of information are considered Non-Identifying Information when they are taken alone or combined only with other Non-Identifying information. We may combine your Personal Information with Non-Identifying Information and aggregate it with information collected from other visitors to attempt to provide you with a better experience, to improve the quality and value of the Website and to analyze and understand how our Website is used. We may also use the combined information without aggregating it to serve you specifically. We may also use your Personal Information to send you our marketing or promotional materials and other information that may be of interest to you. If you decide at any time that you no longer wish to receive such communications from us, please follow the unsubscribe instructions, if any, provided in our communications to you, or contact us via e-mail at the address specified at the end of this Privacy Policy. Please note that we may also use your Personal Information to contact you with notifications related to your use of the Website; you may not opt out of these notifications.

Server Statistics and Log Data. We collect general statistics to track user trends on our Site. These statistics include hits to our server, the types of browsers used to access our Site, page views, and navigational patterns. When you visit the Website, our servers automatically record information that your browser sends whenever you visit a website ("Log Data"). This Log Data may include information such as your computer's Internet Protocol address, browser type or the webpage you were visiting before you came to our Website, pages of our Website that you visit, the time spent on those pages, information you search for on our Website, access times and dates, and other statistics. We use this information to monitor and analyze use of the Website and for the Website's technical administration, to increase our Website's functionality and user-friendliness, and to better tailor it to our visitors' needs. We do not treat Log Data as Personal Information or use it in association with other Personal Information, though we may aggregate, analyze and evaluate such information for the same purposes as stated above regarding other Non-Identifying Information. Excursionist may also use devices called “web beacons” to help us identify when emails sent to you have been received and read. In order to prevent the introduction of viruses and hackers into the Excursionist Site, we may collect information, such as IP addresses, into a log file to be used to identify potential hackers of our site.

Cookies. Excursionist uses "cookies" to collect information. Cookies are small data files assigned by a web server that uniquely identify the browser on your PC. We may use cookies to enable certain features of the Website, to better understand how you interact with the Website and to monitor aggregate usage by visitors and web traffic routing on the Website. You can instruct your browser, by changing its options, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. If you do not accept cookies, however, you may not be able to use all portions of the Website or all functionality of the Website.

4. Security of Your Data

Safeguarding information to help protect you from identity theft is a top priority for Excursionist. While no Internet site can guarantee security, we use physical, electronic, and administrative safeguards to assist us in preventing unauthorized access, maintaining data accuracy, and correctly using your Personal Information. Except as specified in this Privacy Policy, we use commercially reasonable efforts to limit access to your Personal Information to the employees, agents, and officers of Excursionist who need the information for their jobs.We will make any legally required disclosures of any breach of the security, confidentiality, or integrity of your unencrypted electronically stored "personal data" (as defined in applicable state statutes on security breach notification) to you via email or conspicuous posting on our Website in the most expedient time possible and without unreasonable delay, insofar as consistent with (i) the legitimate needs of law enforcement or (ii) any measures necessary to determine the scope of the breach and restore the reasonable integrity of the data system.

5. Communications With You

When you register as a member on the Site, you will be given a choice as to whether you want to receive e-mail messages about special offers. You can modify your choice at any time on your account settings page. You also will be given the opportunity to unsubscribe from commercial messages in any such e-mail we send. Please note that we reserve the right to send you other communications, including service announcements, administrative messages, and surveys relating either to your account or to your transactions on the Site, without offering you the opportunity to opt out of receiving them.

6. Sharing and Disclosing Your Information

Sharing information with third-parties. Except as noted in this Privacy Policy, we do not sell or share your Personal Information. We may share information with carefully selected vendors and business partners with whom we work including:

  • Suppliers, such as (but not limited to) hotels, cruises, car rental, home rental, yacht charter or other activity providers, who deliver our experiences around the world. We do not share your email address with these suppliers unless they need it to fulfill the travel booking you have made on the Site, and we restrict their use of this information to that purpose.
  • Third-party vendors who provide services or functions on our behalf, including (but not limited to) credit card processing, business analytics, customer service, marketing, distribution of surveys or sweepstakes programs, and fraud prevention. These companies will have access to your personal information needed to perform their functions but are not permitted to share or use the information for any other purpose.
  • We may disclose Personal Information we collect from you if required to do so by law or in the good-faith belief that disclosure is necessary (a) to obey the law or comply with legal process served on us or our affiliates; (b) to protect and defend our rights or property or the rights or property of other users of our Site; (c) to act in an emergency to protect the personal safety of users of our Site or the public; or (d) in connection with our Terms of Service and other agreements.
  • In connection with a corporate transaction, such as (but not limited to) a divestiture, merger, consolidation, or asset sale, or in the unlikely event of bankruptcy.
  • We may provide aggregate statistics about our customers, sales, traffic patterns and related Site information to reputable third party vendors, but these statistics do not include Personal Information.

We also use other information about you for general purposes such as (but not limited to) providing travel confirmation and updates; processing bills and providing travel notifications; to notify you about special offers and products or services that may be of interest to you; to resolve disputes, collect fees, or troubleshoot problems; to prevent potentially prohibited or illegal activities; to enforce our Terms of Service; and as otherwise described to you at the point of collection.

Our Website contains links to other websites. The fact that we link to a website or display a banner ad or other type of advertisement is not an endorsement, authorization or representation of our affiliation with any of those third parties, nor is it an endorsement of their privacy or information security policies or practices. We are not responsible for how these other companies or organizations collect, use, disclose, or secure the information that you provide them. If you choose to access a third party Site linked to our Site, you do so at your own risk and subject to any terms of service or privacy policy (if any) associated with such third party Sites.

8. Changing or Deleting Your Information

If you would like us to change or delete your Personal Information in our system, please contact us and we will attempt to accommodate your request if we do not have any legal obligation to retain the Personal Information. See below for contact information. Please note we may retain server/backup copies of all such data.

= 9. Collection Of Information From Children

This Website is not directed to persons under 18. Users of our Site are required to be at least 18 years old, and any user under 18 is not an authorized user. We do not knowingly collect personal information from children under 13. If we learn that a user is under thirteen (13) years of age, we will promptly delete any Personal Information we have collected about that user.

10. Your California Privacy Rights.

As provided by California Civil Code Section 1798.83, a California resident who has provided Personal Information to a business with whom he/she has established a business relationship for personal, family, or household purposes (“California customer”) is entitled to request information about whether the business has disclosed Personal Information to any third parties for the third parties’ direct marketing purposes. In general, if the business has made such a disclosure of Personal Information, upon receipt of a request by a California customer, the business is required to provide a list of all third parties to whom Personal Information was disclosed in the preceding calendar year, as well as a list of the categories of Personal Information that were disclosed. However, under the law, a business is not required to provide the above-described lists if the business adopts and discloses to the public (in its privacy policy) a policy of not disclosing customer’s Personal Information to third parties for their direct marketing purposes unless the customer first affirmatively agrees to the disclosure, as long as the business maintains and discloses this policy. Rather, the business may comply with the law by notifying the customer of his or her right to prevent disclosure of Personal Information and providing a cost free means to exercise that right.

As stated in this Privacy Policy, we do not share information with third parties for their direct marketing purposes unless you affirmatively agree to such disclosure -- typically by opting in to receive information from a third party that is participating in some activity describes on our Site. If you do ask us to share your information with a third party for its marketing purposes, we will only share information in connection with that specific activity, as we do not share information with any third party on a continual basis. To prevent disclosure of your Personal Information for use in direct marketing by a third party, do not opt in to such use when you provide Personal Information on our Site. Please note that whenever you opt in to receive future communications from a third party, your information will be subject to the third party's privacy policy. If you later decide that you do not want that third party to use your information, you will need to contact the third party directly, as we have no control over how third parties use information.
